Privacy and Cookie Policy – SoftFlow Sp. z o.o.

SoftFlow Sp. z o.o. (hereinafter “SoftFlow”) places great importance on respecting the rights of internet users, with particular emphasis on the right to privacy. The privacy policy outlined below explains the rules we follow regarding the collection and processing of personal data.

This Privacy and Cookie Policy applies to the website (hereinafter the “Service”) operated by SoftFlow.

WHO IS THE DATA CONTROLLER

The data controller, within the meaning of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 (GDPR), is SoftFlow, headquartered at ul. Chmielna 73, 00-801 Warsaw, Poland, registered in the National Court Register under KRS number 0001108235, NIP 5213872910.

WHAT DATA DO WE COLLECT?

  • Data from forms:
    Data submitted via the contact form is stored in our email inbox for the purpose of managing correspondence and sending responses. This data is not shared with third parties.
  • Server logs:
    Using the website involves sending queries to the server hosting the site. Each query is recorded in server logs, which include the IP address, date and time, browser information, and operating system. These logs are not linked to any specific user and are used solely for administrative purposes.
  • Automatically collected data:
    During your visit, data such as your IP address, domain name, browser type, and operating system are collected automatically. See the cookie section for more details.

PURPOSE AND LEGAL BASIS OF PROCESSING

Your personal data may be processed for the following purposes:

– to provide the Service (Art. 6(1)(b) GDPR);
– for marketing activities conducted by SoftFlow (Art. 6(1)(a) GDPR);
– to respond to inquiries, complaints, or legal requests (Art. 6(1)(c) or (f) GDPR);
– to comply with legal obligations (Art. 6(1)(c) GDPR);
– to establish, exercise, or defend legal claims (Art. 6(1)(f) GDPR).

We will retain your personal data:

– for the duration of your use of the Service;
– as required by applicable laws;
– until consent is withdrawn or an objection is raised;
– as long as necessary for the establishment, defense, or exercise of claims.

The Service does not use automated decision-making systems.

DATA SUBMISSION OBLIGATION

Providing personal data in the contact form is necessary for SoftFlow to respond to your inquiry. Submitting the form implies consent to process the data provided. You may withdraw your consent at any time, without affecting the lawfulness of processing before the withdrawal.

YOUR RIGHTS

You have the right to:

– correct or supplement incomplete data;
– request data deletion or processing restriction;
– object to further processing;
– lodge a complaint with the data protection authority (President of the Personal Data Protection Office in Poland).

– processors acting on behalf of SoftFlow (e.g., IT service providers);
– legal firms (e.g., handling proceedings for SoftFlow);
– third parties using cookies;
– authorities and institutions authorized by law.

HOW TO GET INFORMATION ABOUT DATA PROCESSING?

Address all correspondence on matters related to the processing of your personal data to the Administrator’s address marked “Personal Data” or to rodo@SoftFlow.tech.

  1. Provision of the Service (Article 6(1)(b) RODO);
  2. to conduct marketing activities undertaken by SoftFlow, either on its own or in cooperation with other entities (Article 6(1)(a) RODO);
  3. responding to letters, inquiries, requests, complaints (Article 6(1)(c) RODO or Article 6(1)(f) RODO);
  4. to fulfill a legal obligation incumbent on SoftFlow (Article 6(1)(c) RODO);
  5. to establish, defend and pursue claims related to the use of the Site (Article 6(1)(f) RODO).

We will keep your personal data for a period of time:

  1. use of the Website;
  2. Resulting from applicable laws;
  3. To withdraw consent or object;
  4. necessary to establish, defend and assert claims.

SoftFlow service does not use systems for automated decision-making.

DATA OBLIGATION

Providing personal data in the Form is necessary for SoftFlow to respond to the submitted inquiry.
Providing data in the Form and submitting it is at the same time giving your consent to SoftFlow to process the data contained in the submitted inquiry.
You have the right to withdraw your consent at any time. The withdrawal of consent does not affect the legality of the processing of your data, which was carried out on the basis of the consent given before its withdrawal.

WHAT RIGHTS YOU HAVE

You have the right to:

  • request access to personal data concerning you
  • rectification of data,
  • request completion of incomplete personal data, including by providing an additional statement,
  • erasure of your data or restriction of processing
  • to object to further processing of your personal data

If you have doubts about the accuracy of SoftFlow’s processing of your personal data, you have the right to lodge a complaint with the supervisory authority (President of the Office for Personal Data Protection).

WHO WILL BE THE RECIPIENT OF YOUR DATA AND WHERE IT WILL BE TRANSFERRED

Your data may be transferred to the following categories of recipients:

processors in connection with SoftFlow’s outsourced activities carried out on behalf of SoftFlow (e.g., entities maintaining IT systems);
law firms contracted by SoftFlow, e.g., to conduct proceedings;
entities that may post their own cookies;
entities or authorities authorized by law (including courts, prosecutors, supervisory authorities).
